Senate Bill Could Inadvertently Put Deserving Patents at Risk, Says BSA

WASHINGTON, DC - The Business Software Alliance (BSA) applauded Senator Chuck Schumer (D-N.Y.) for his determination to curb frivolous patent litigation, but expressed serious concerns that his “Patent Quality Improvement Act” could put at risk many deserving patents, according to the Alliance.
“Senator Schumer’s bill would expand a provision intended for a small class of patents, which has been in effect for just six months. We need more time to assess the provision’s impact on the patent system,” said BSA Director of Government Relations Tim Molino. “We appreciate the Senator’s attention to the issue of frivolous patent litigation. The problem is real, but we are concerned this response may be too broad.”
“The best way to curb unwarranted lawsuits would be for Congress to correct the wild imbalance in financial incentives that makes opportunistic litigation such an attractive business model for trolls,” said Molino. “And there are practical ways to improve the quality of patents being issued, such as giving examiners more resources and better training on the front end of the process. BSA looks forward to working with Senator Schumer and others in Congress on these sorts of solutions.”
