Litigation battle continues as Cupertino asks court to list Galaxy Note II et al

Apple Inc sought the addition of six Samsung products, including the Galaxy Note II, to its patent complaint against the South Korean electronics giant, Reuters reported yesterday. A press release by itp.net

The case is one of two being heard by the US District Court in San Jose, involving claims of patent violation by Apple against Samsung. The first awarded Apple over $1bn in damages in late August, a decision that is currently under appeal by Samsung.

The Cuertino-based iPhone maker also wants to add the Samsung Galaxy S III, powered by Google's new Android "Jelly Bean" OS, the Samsung Galaxy Tab 8.9 Wifi, the Samsung Galaxy Tab 2 10.1, the Samsung Rugby Pro, and the Samsung Galaxy S III Mini, to its action, according to a court filing on Friday.

"Apple has acted quickly and diligently to determine that these newly released products do infringe many of the same claims already asserted by Apple," the company said in the filing.

Requests for comment from Samsung were not immediately answered, Reuters reported.

Apple's second lawsuit, filed in Feruary, includes several Samsung smartphones and tablets, including the Galaxy Nexus, and alleges that they violate eight patents. Samsung denied infringement and filed a counter-suit that accused Apple's iPhone and iPad of violating eight of its patents. On November 15 a US judge gave Samsung leave to pursue its allegation that the iPhone5 also infringes its patents.
