A Company is Defamed by Saudi MCI in Dammam for Counterfeiting Clothes Trademark

RIYADH - The Saudi Ministry of Commerce and Investment has defamed a wholesale and retail company in Dammam, selling ready-made garments under forged trademark. A judgment issued by the Criminal Court, imposing penalties on the said company for violating the trademark system, also for violating the intellectual property rights.
 
The Ministry pointed out that the said company and its manager were found guilty of possessing, displaying and selling men's clothing after forging the trademark, which is registered with MCI. Therefore, a fine of SR 100,000 was imposed on the said company with the confiscation of all seizures bearing the counterfeit trademark, and the sentence to be published in two local newspapers at the expense of the defendants.
 
According to the Ministry, the details go back when MCI inspectors received a complaint from a local company stating that its own registered trademark has been forged and used by others. Accordingly, MCI inspectors responded and proceeded in the investigation, which resulted in the seizure of 800 items offered for sale in one of the company's shops in Dammam. Then, the case was referred to the judicial authorities for taking the legal procedures.
 
It is worth mentioning that Article 43 of the Trademark Law stipulates that "Without prejudice to any more severe penalty, a penalty of imprisonment for a period not exceeding one year and a fine of not less than SR 50,000 and not more than one million Riyals, or either of these two penalties shall be imposed on those who forge or imitate a registered trademark, in a way that would mislead or deceive the public, as well as anyone who use a false or counterfeit trademark intentionally, and any person who intentionally place on his products or use a trademark owned by others, and anyone who offers, put up for sale, sell or acquire for the purpose of selling any products with a fake or counterfeit trademark, as well as all those who intentionally offer services under such counterfeit or fake trademark".
 
MCI would like to affirm its on-going efforts and endeavors to take all legal procedures against those involved in the storage, distribution, displaying or selling products or items under forged or counterfeits trademarks, besides those violating the intellectual property rights. MCI calls on all consumers to lodge their complaints and observations through MCI Consumer Call Center (1900) or through the application of a Commercial Violation Report, or via the Ministry’s website.
