ALICANTE - After being unanimously adopted by the Management Board of the European Union Intellectual Property Office (EUIPO) in November 2020, the CP12 Common Practice/Recommendations on ‘Evidence in trade mark appeal proceedings’ has now been published across the EU, according to the official website of EUIPO.

CP12 is the first convergence initiative in the area of trade mark appeal proceedings, and focuses on delivering a set of recommendations in relation to evidence, in particular, its types, means, sources and identification of relevant dates, as well as its structure and presentation, and the treatment of confidential evidence.

As in many aspects the Common Practice deals with evidence in trade mark proceedings in general, its potential applicability may go beyond appeal proceedings. It may therefore be used in wider contexts including but not limited to first instance trade mark proceedings.

The Common Communication document, which includes the CP12 Common Practice/Recommendations and complementary information, such as implementation dates and affected proceedings for each of the implementing Member State IP Office, has been simultaneously published on the websites of the EU IP Offices on 31 March 2021. The document is available here in all EU languages.

The CP12 Common Practice/Recommendations is the result of consultations and contributions submitted by different stakeholders over the past two years as well as the fruitful collaboration of the Working Group, composed of experts from internal and external appeal bodies, including the EUIPO Boards of Appeal, and User Associations.
