South Korea’s MOIP Launches General Oversight Organization to Swiftly Accelerate IP (Intellectual Property)-AX (AI Transformation)

DAEJEON - The South Korea’s Ministry of Intellectual Property (MOIP), led by Minister KIM Yong Sun, announced that it has established the “Intellectual Property Artificial Intelligence Transformation Division (hereinafter referred to as IP-AX Division),” a central coordinating division designed to advance AI-based IP administration systems and respond proactively to paradigm shifts brought about by the rapid advancement of AI technologies, according to the official website of MOIP

The broader trend of AI Transformation, or AX, has also brought significant changes to the field of IP. AI is playing a much greater supporting role in the invention and application process, while the use of AI technologies is also expanding in examination and trial proceedings. At the same time, advances in AI are continuously giving rise to a wide range of IP-related issues across laws, systems, industries, and policies, including patent disputes in the AI sector, deepfakes involving AI-generated outputs, and the unauthorized use of training data for AI. In response to these changes, there has been a growing need to examine, from a fundamental perspective, the impact that AI will have on the field of intellectual property and to pursue AX in a systematic manner. MOIP has therefore established a new division to oversee these efforts.

The newly established IP-AX Division will focus on three core missions.

① Updating IP Laws and Systems for AI Transformation and Re-establishing Relevant Standards
The IP-AX Division will monitor AI-related developments in major jurisdictions, including the United States and Europe, as well as at the World Intellectual Property Organization (WIPO). It will also study ethical standards that should be observed when AI is introduced into the public and private sectors in the field of intellectual property. Based on these efforts, MOIP will carefully review whether IP-related laws and systems need to be revised and pursue legislative measures where necessary.

② Formulating IP-AX Strategies to Build an “AI-Native” IP Administration System
In line with government policy directions, including the AI Action Plan announced by the National AI Strategy Committee, MOIP will advance AX in the field of intellectual property by identifying administrative and public services where AI should be introduced and expanded, and by improving related procedures and systems. MOIP will also provide education and capacity-building programs to enhance AI literacy among its employees.

③ Supporting the AI Transformation of the Private IP Industry and Promoting the Accessibility of AI Training Data
The IP-AX Division will support IP service companies in designing business models and developing services that use IP big data, AI, and other technologies to provide more advanced patent and technology search, corporate analysis, and litigation outcome prediction services. To this end, MOIP will also support the opening of highly useful AI training data.

The launch of the new division provides MOIP with a foundation for pursuing IP-AX-related initiatives in a consistent manner and concentrating its human resources and expertise. This is expected to enable MOIP to proactively formulate IP-AX strategies and risk-response measures, moving beyond a passive response to advances in AI technology and pursuing more active and forward-looking IP-AX policies from a mid- to long-term perspective.

Minister Kim stated, “AI has now surpassed being mere technology. It is transforming the very paradigm of IP. Through the launch of IP-AX Division, we will dedicate our efforts to ensuring that the Republic of Korea establishes itself as a rule-maker that leads global AI-IP norms and helps shape the global order, while providing world-class AI-based IP administrative services.”
